This Privacy & Data Use Policy (“Policy”) explains how Hormizon (“Company,” “we,” “us,” “our”) collects, uses, discloses, and protects your information when you visit our website, make a purchase, use our services, or interact with our content. By accessing our website or providing information to us, you agree to the terms of this Policy and our Terms of Sale, including the Arbitration Agreement and Class-Action Waiver.

A. Information You Provide Directly

Name, email address, shipping and billing address, phone number, payment information (processed securely via third-party processors), account login details (if you create an account), subscription selections and preferences, customer support communications, survey responses, product reviews, or UGC submissions.

B. Automatically Collected Information

We use cookies, pixels, analytics tools, session-replay scripts, and similar technologies to collect device information, IP address, browser type/version, pages visited and time spent, shopping cart and checkout behavior, click-path and scroll data, referring URLs, approximate geolocation (non-precise), and interaction with popups, videos, and form fills.

C. Information from Third Parties

We may receive information from payment processors, advertising partners (Meta, Google, TikTok, etc.), affiliate networks, social media integrations, and fraud-prevention vendors. This data helps verify transactions, improve experience, and prevent abuse.

2. How We Use Your Information

A. Order Processing & Fulfillment

Processing payments, shipping products, managing subscriptions, and providing customer service.

B. Website Functionality & Optimization

Improving site speed and usability, personalizing your shopping experience, and troubleshooting technical issues.

C. Marketing & Advertising

Including but not limited to retargeting ads, lookalike audiences, behavioral advertising, email and SMS marketing, and promotional offers and recommendations. We only send marketing communications if you have consented or where permitted by law.

D. Fraud Prevention & Security

Verifying identity, monitoring suspicious activity, and protecting against chargebacks and fraudulent transactions.

E. Compliance

Legal obligations, tax and accounting, and regulatory recordkeeping (including for ROSCA, subscription compliance, and data retention rules).

F. AI Tools & Automation

We may use AI systems to improve customer service responses, analyze marketing performance, generate product recommendations, and detect anomalies or fraud patterns. AI outputs are reviewed and controlled by humans where required.

3. Cookies, Pixels & Tracking Technologies

We use first-party and third-party cookies for website operations, analytics (e.g., Google Analytics), advertising (e.g., Meta Pixel, TikTok Pixel), conversion tracking, shopping cart persistence, and subscription reminders. You may opt out of certain cookies through your browser settings. However, disabling cookies may affect functionality.

Session Replay / Chat Widgets: We may use session replay tools, chat widgets, or behavioral analytics to understand how you interact with our website. These tools collect data about clicks, scrolls, and interactions for fraud prevention, customer experience, and troubleshooting. These vendors act as our service providers or processors and are contractually required to use the data solely on our behalf.

4. Behavioral Advertising Disclosure

We may share limited information (hashed email, device identifiers, pixel data) with advertising platforms for retargeting, frequency capping, conversion tracking, and lookalike audience creation. You can opt out of interest-based advertising via your Meta preferences, Google Ad Settings, NAI opt-out tools, or email unsubscribe links. 5. How We Share Your Information

We do not sell your personal information for money. We may share your information with service providers (payment processors, shipping carriers, analytics vendors, customer service tools), marketing partners (ad networks, email/SMS platforms), fraud prevention services, fulfillment centers and warehouses, and legal authorities when required. All service providers are contractually obligated to use your data solely for our purposes and not for their independent commercial use.

6. Data Storage & Retention

We retain data for as long as reasonably necessary for fulfilling orders, maintaining subscriptions, complying with legal obligations, fraud prevention, resolving disputes, and accounting and auditing purposes. Payment data is tokenized and stored by PCI-compliant processors.

7. Your Rights Over Your Data

Depending on your state (e.g., CA, CO, CT, VA), you may have certain rights: access your personal information, request deletion, request correction, opt out of targeted advertising, opt out of sharing, request a copy of your data, and appeal a denial of your request. 8. Children’s Privacy

We do not knowingly collect or solicit data from children under 13 (or 16 where restricted). If we learn that data was collected from a minor without consent, we will delete it promptly.

9. Data Security

We implement commercially reasonable safeguards to protect your data, including SSL encryption, tokenized payment processing, access controls, regular vendor audits, and intrusion detection systems. However, no system is 100% secure. By using our services, you acknowledge and accept these inherent risks.

10. International Users

If you access our website from outside the United States, you understand that your data will be transferred to, processed in, and stored in the U.S., where privacy laws may differ.

11. Third-Party Links & Integrations

Our website may link to third-party sites or services. We are not responsible for their privacy practices. You should review their policies before providing any personal information.

14. Governing Law, Arbitration & Class-Action Waiver

All disputes arising out of or related to data collection, privacy practices, cookie usage, ad tracking, SMS/email communications, or any alleged misuse of data must be resolved through binding individual arbitration under our Terms of Sale. You waive the right to bring or participate in class actions, jury trial rights, and collective or representative proceedings.

15. SMS / MMS Text Message Marketing Program Privacy Policy

Your privacy is extremely important to us. We will only use the information you provide through our SMS/MMS text message marketing program (“Program”) to transmit your mobile messages and respond to you, if necessary. This includes but is not limited to sharing information with platform providers, phone companies (carriers), and other vendors who assist us in the delivery of mobile messages.

WE DO NOT SELL, RENT, LOAN, TRADE, LEASE, OR OTHERWISE TRANSFER FOR PROFIT ANY PHONE NUMBERS OR CUSTOMER INFORMATION COLLECTED THROUGH THE PROGRAM TO ANY THIRD PARTY.

Nonetheless, we reserve the right at all times to disclose any information as necessary to satisfy any law, regulation, or governmental request, to avoid liability, or to protect our rights or property. When you complete forms online or otherwise provide us with information in connection with the Program, you agree to provide accurate, complete, and true information. You agree not to use a false or misleading name or a name that you are not authorized to use. If, in our sole discretion, we believe that any such information is untrue, inaccurate, or incomplete, or you have opted into the Program for an ulterior purpose, we may refuse you access to the Program and pursue any appropriate legal remedies.

California Civil Code Section 1798.83 and The General Data Protection Regulation 2016/679 (GDPR) allow users of the Program who are California or European Union residents to request certain information regarding our disclosure of the information you provide through the Program to third parties for their direct marketing purposes.
